Who are we?

We are MOJIWORKS LIMITED, a company incorporated and registered in England and Wales with registered address at 171a High Street, Guildford, Surrey, GU1 3AJ, and registered number 10324569 (“Mojiworks”, “we” or “us”), and we are a social games company.  Where we decide the means or purpose of processing your personal data, we are the “controller."

What’s this notice about?

This notice explains how we process personal data, as a controller, relating to:

• “Website Visitors”, who are individuals that visit our website: www.mojiworks.com (“Website”)
• “Game Players”, who are individuals that play Mojiworks’ games (“Games”)
• “Testers”, who are individuals that volunteer to participate in one of our closed testing programs (“Testing Programs”)
• “Moderators”, who are individuals that volunteer to participate in one of our Discord server moderator programs (“Moderator Programs”)

Together the Website Visitors, Game Players, Testers and Moderators are “Users” (and “you” and “your” shall refer to any User).  We update this notice from time to time, so Users should check back in on a regular basis. Please note that other websites or services mentioned on the Website or in our Games are not operated by us, and you should refer to the privacy notices on those websites to understand how they process personal data.

What are your rights?

Users have the following rights, although these rights may be limited in some circumstances:

• Ask us to send a copy of your personal data to you or someone else 
• Ask us to restrict, stop processing, or delete your personal data
• Object to our processing of your personal data
• Object to use of your personal data for direct marketing purposes 
• Ask us to correct inaccuracies in your personal data

Your Personal Data And How We Use It

Analytics

PURPOSE – We process certain information relating to the device on which Users are accessing our Games to: (i) identify Users; (ii) improve, test and monitor the quality and delivery of our Games; (iii) identify and correct any problems in our Games (such as bugs or problems preventing in-Game progression); and (iv) perform essential business operations.

CATEGORIES OF PERSONAL DATA – We collect the following information directly from Users when they access our Games:  device vendor, model and operating system; timezone settings; version of Game; Discord userID and Discord display name, group ID and group name.

HOW WE USE IT – We process this personal data on the basis of our legitimate interests, being to: (i) promote the success of our business, our Games and related services; (ii) further our commercial interests; and (iii) understand how Users use our Games. Such interests are not overridden by Users’ interests or fundamental rights and freedoms.

RECIPIENTS – The data collected through analytics is stored on secure servers hosted by Google Cloud Platform (GCP). We use dbt (data build tool) to manage the data flows and transformations within our analytics infrastructure. Both GCP and dbt provide robust security measures to safeguard your data from unauthorised access, loss, or theft.

We may share certain information with Discord Inc. where we make certain Games available via their social media platform, “Discord”.

HOW LONG WE KEEP THIS INFORMATION FOR – We retain analytics data for as long as necessary to fulfil the purposes outlined above.

Gameplay

PURPOSE – We process certain information about Game Players in order to: (i) allow Game Players to use our Games (including certain functionalities on our Games); (ii) understand how and when Game Players use our Games; (iii) allow Game Players to set up accounts when playing our Games; and (iv) generally run, operate and maintain the Games.

CATEGORIES OF PERSONAL DATA – We collect the following information directly from Users when they access and play our Games: Discord User ID, Discord display name and data generated during matches and sessions, including scores, level progression, session times, mode selections, stage selections, item inventory and purchase history.

HOW WE USE IT – We process this personal data on the basis of our legitimate interests, being to: (i) improve the delivery of our Games; (ii) promote the success of our business; and (iii) improve the Game Players’ user experience when using this Game. Such interests are not overridden by Game Players’ interests or fundamental rights and freedoms.

RECIPIENTS – We may share certain information with Discord Inc. where we make certain Games available via their social media platform, “Discord”.

HOW LONG WE KEEP THIS INFORMATION FOR – We retain gameplay data for the lifetime of the Game, and as long as necessary to fulfil the purposes outlined above.

Enquiries

PURPOSE – We process certain information about Website Visitors in order to: (i) review and respond to their enquiries, complaints or questions about our Games, Website or related services; (ii) provide quality customer care; and (iii) improve, test and monitor the quality and delivery of our Games.

CATEGORIES OF PERSONAL DATA – We collect the following information directly from Users when they access our Website: name, contact information (such as email address or telephone number) and any other information that Users submit as part of their enquiries, complaints or questions.

HOW WE USE IT – We process this personal data on the basis of our legitimate interests, being to: (i) understand how Users use our Games, Website or related services; and (ii) promote the success of our business. Such interests are not overridden by Users’ interests or fundamental rights and freedoms.

RECIPIENTS – Certain information relating to Website Visitors is shared with Google LLC when enquiries are sent to us, as we use Google Mail to manage email communications. When enquiries are sent to support@mojworks.com, certain information is shared with Help Scout PBC, the help desk platform that we use.

HOW LONG WE KEEP THIS INFORMATION FOR – An individual’s data will be retained for 2 years from the date that the relevant enquiry, complaint or question was resolved.

Job Applications

PURPOSE – We process certain information about Website Visitors in order to assess whether they are suitable for a role at Mojiworks, including to consider their skills and qualifications, when they submit a job application on our Website. We’ll also communicate with Website Visitors about the role and the recruitment process and keep appropriate records of the process.

CATEGORIES OF PERSONAL DATA – We collect the following information directly from Website Visitors when they submit job applications via our Website: name, email address, CV, any additional files uploaded, cover letter and any message submitted as part of the application. We collect relevant user profile information from LinkedIn when Website Visitors apply for a Mojiworks job via LinkedIn.

HOW WE USE IT – We process this personal data to pursue our legitimate interests, being to: (i) hire suitably qualified individuals; and (ii) operate our business and promote its success. Such interests are not overridden by Website Visitors’ interests or fundamental rights and freedoms.

RECIPIENTS – Certain information relating to Website Visitors is shared with LinkedIn when Website Visitors apply for a Mojiworks job via LinkedIn.

HOW LONG WE KEEP THIS INFORMATION FOR – Where an individual is:

1. successful with their application, their data will be retained in accordance with Mojiworks’ Employee Privacy Notice; or
2. not successful with their application, their data will be retained for 2 years following the date on which a decision was made on their application.

Testing Programs

PURPOSE – We process certain information about Testers and Testing Program Applicants in order to process applications for participating in our Testing Programs and, if selected, to collect and review their feedback related to tests conducted within the Testing Programs.

CATEGORIES OF PERSONAL DATA – We collect the following information directly from Testers and Testing Program applicants: Discord User ID, Discord username, email address, age range, responses to any questions in the application form, video of your gameplay whilst participating in the Testing Program (including your commentary during that gameplay) and any other personal data submitted as part of their application to participate in one of our Testing Programs.

HOW WE USE IT – We process this personal data to pursue our legitimate interests, being to: (i) promote the success of our business, our Games and related services; (ii) further our commercial interests; (iii) understand how Testers use unreleased Game content; and (iv) improve the Game Players’ user experience when using Games and Game features, including unreleased versions. Such interests are not overridden by Testers’ interests or fundamental rights and freedoms.

RECIPIENTS – Certain information relating to Testers is shared with Google LLC when they apply to be a Tester, as we use Google Forms to collect applications. We may also share certain Tester information with Discord Inc. as part of running the Testing Programs on the Discord platform, and/or with Reddit Inc. as part of running the Testing Programs on the Reddit platform..

HOW LONG WE KEEP THIS INFORMATION FOR – Where an individual applies to be a Tester, and is:

1. not selected to participate in a Testing Program, their data is retained for 2 years following the date on which a decision was made on their application; and
2. selected to participate in a Testing Program, their data is retained for 2 years following the end of the relevant Testing Program.

Moderator Programs

PURPOSE – We process certain information about Moderators and Moderator Program Applicants in order to process applications for participating in our Moderator Programs and, if selected, to collect and review their feedback related to the Moderator Programs.

CATEGORIES OF PERSONAL DATA – We collect the following information directly from Moderators and Moderator Program Applicants: Discord User ID, Discord username, email address, age range, responses to any questions in the application form and any other personal data submitted as part of their participation in one of our Moderator Programs.

HOW WE USE IT – We process this personal data to pursue our legitimate interests, being to: (i) promote the success of our business, our Games and related services; (ii) further our commercial interests; (iii) monitor and evaluate Moderator activity and performance in the official Discord servers for our Games. Such interests are not overridden by Testers’ interests or fundamental rights and freedoms.

RECIPIENTS – Certain information relating to Moderators and Moderation Program Applicants is shared with Google LLC when they apply to be a Moderator, as we use Google Forms to collect applications. We also share certain Moderator information with Discord Inc. as part of running the Moderator Programs on the Discord platform.

HOW LONG WE KEEP THIS INFORMATION FOR – We will retain this information for these purposes outlined above until you have withdrawn your participation in the Moderator Programs, or you have withdrawn your consent for your personal data to be used for these purposes.

Storage, Transfers, and Disclosure

Storage & Transfers

We are based in the United Kingdom, regularly collaborate with an international network of partners and may from time-to-time use subcontractors based in other countries. As a result, there may be occasions where we transfer personal data to a country which does not provide an adequate level of protection. Where this is the case, we use contracts which give personal data the same protection it has in the UK. For more information, please contact us using the contact details at the start of this notice.

Disclosure

We may disclose your personal data:

• Where required by law, government, competent authorities or the courts or to establish, exercise or defend our legal rights, and for the purposes of preventing crime and fraud (for example, we may share personal data with our professional advisors, investigators, or credit reference agencies).
